Terms of Service

These Terms of Service ("Terms") govern your use of growgmb.com and any associated services (the "Service") provided by GrowGMB ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms. If you don't agree, don't use the Service.

1. Eligibility

You must be at least 18 years old and have legal authority to enter into this agreement (including, if applicable, on behalf of an organization).

2. Account responsibility

You are responsible for safeguarding your credentials and for all activity under your account. Notify us immediately at security@growgmb.com of any unauthorized use.

3. Acceptable use

You agree not to:

• Reverse engineer, scrape, or attempt to extract data from the Service beyond what is exposed by our APIs.
• Use the Service to violate Google Business Profile policies, including review manipulation or fake content.
• Send spam, malware, or unsolicited messages via our publishing or email features.
• Use AI features to generate misleading, defamatory, or illegal content.
• Resell credits or accounts outside of the white-label features explicitly offered on the Agency plan.

4. Plans, billing, and credits

4.1 Subscriptions

Plans are billed monthly in Indian Rupees (INR), processed through Razorpay. The subscription auto-renews until you cancel. Cancellation takes effect at the end of the current billing period.

4.2 Magic Coins (credits)

Most paid actions on the Service consume credits ("Magic Coins"). Each plan includes a monthly credit quota that resets on renewal. You can purchase additional credits at tier-specific pricing. Credits are non-refundable once consumed and do not roll over to the next billing period unless explicitly stated.

4.3 GST and invoices

All prices on the Service are exclusive of GST unless specifically stated. GST will be added to your invoice as required by Indian tax law. You can request a GSTIN-tagged invoice from billing settings.

4.4 Failed payments

If a renewal payment fails, your plan moves to Past Due. After 7 days of unresolved failure your plan is downgraded to Free tier; data is retained for 90 days during which you can reactivate.

5. Refunds

Our refund policy is summarized in our Refund Policy. In short: pro-rata refund within 7 days of a fresh subscription if you have consumed less than 20% of your monthly credits. After that window, refunds are at our discretion and generally not available.

6. Google Business Profile connection

You authorise GrowGMB to access your connected Google Business Profile via Google's official APIs solely to power the features you trigger. You may disconnect at any time from the dashboard. We are not responsible for changes Google makes to its APIs, quotas, or terms that may affect feature availability.

7. AI content disclaimer

AI-generated outputs — including drafts, replies, images, and analyses — are not guaranteed to be accurate, original, or free from bias. You are responsible for reviewing and approving every AI output before it is published or sent. We are not liable for the consequences of publishing AI-generated content.

8. White-label and agency plans

Agency plan customers may resell access to clients under their own subdomain. The agency remains responsible for compliance, billing relationships with their clients, and enforcing acceptable use among their seats.

9. Service availability

We aim for high availability but do not guarantee uninterrupted access. Planned maintenance, third-party outages (Vercel, Neon, Google, Razorpay), or force majeure events may cause downtime. We do not offer service credits unless a separately signed enterprise SLA is in place.

10. Intellectual property

The Service, including its design, code, and content (excluding your data), is owned by GrowGMB. You retain ownership of your data and any content you upload. By using AI features, you grant us a limited licence to process your data through the AI providers listed in our Privacy Policy.

11. Termination

You may close your account at any time from settings. We may suspend or terminate your account for breach of these Terms, abuse, or non-payment, with reasonable notice except where immediate suspension is necessary to protect the Service or other users.

12. Liability

To the maximum extent permitted by law, GrowGMB is not liable for indirect, incidental, consequential, or punitive damages. Our total liability in any 12-month period is limited to the fees you paid during that period.

13. Indemnity

You agree to indemnify GrowGMB against any claim arising from your misuse of the Service, violation of these Terms, or infringement of any third-party right by content you publish through the Service.

14. Governing law and jurisdiction

These Terms are governed by the laws of India. Disputes shall be subject to the exclusive jurisdiction of the courts at Bengaluru, Karnataka.

15. Changes to Terms

We may update these Terms. Material changes will be communicated by email or in-app notice. Continued use of the Service after the effective date constitutes acceptance.
